well this is the second thing like this in 2 days or more correctly ever since i won MFA. ODD HUH...The other day i came up to a left turn light was green and car in front starts to go then it changed to the second green or green yield. she had tons of time but she hesitated and hit the brakes. naturally i wasn't expecting it so i barely tapped her. there was no damage done to either car. we agreed not to get cops involved, however i filled out a report to cover my own butt. one time another mustang hit me in my stang. it messed his up but not mine, we decided the same thing, a month later my rates increased bc he called it in. then an hour ago, i pull into Pep Boys to look at exhaust tips and its windy as all get out here. i hear cart wheels going crazy, i look around, expecting to see some kids riding in a shopping cart. instead i look up just in time to see a cart come flying off the raised sidewalk and into my pass side front fender. i was expecting the worst, luckily it only ripped off the short piece of trim in front of the door. i went inside with the cart and told management. they were totally stunned as to what to do. i said,"do you sell any 2 way tape, give me a roll of it and we'll call it good. so i'm repainting the trim in my kitchen and gonna put it on later, maybe tommorow

I am surprised they gave you the tape. Most store chains e.g. Walmart have posted in the parking lot they aren't responsible for cart damage. Should not be too hard to sand, prime, paint, clearcoat that little guy though

if they don't have signs stating such then its possible. but I mean heck the tape is what $3? im sure the store manager wasn't gonna make an issue and possibly lose a customer over $3 and bring a tad bit of bad business towards them

actually i made the piece of trim from a piece off the drivers side. my car was missing it when i bought it. junkyards didn't have any of that side or piece so they just gave me a drivers door piece, so i measured and figured out they were the same only opposite with the angled ends. it was on with 2 way tape to begin with. you'd never know. stupid winpc defender trashed my computer and changed my settings around.

They are still responsible for damage done by their property to anothers. They would have been fools to deny you the tape. I managed big box drug stores for 10 years and had to deal with it may times. They hope that most people will justy leave.

More stores should adopt the shopping cart policy the store chain "Aldi" has set in place. To use a shopping cart you have to insert a quarter into the mechanism on the carts. Then you can use the cart. If you want your quarter back you will take the time to put it back in the chain of carts. Likely if you don't care enough to to return your cart to get your quarter back, someone else wants that quarter and will return it to it's proper place. This place has one of the cleanest lots I've ever seen. I can confidently say I have NEVER seen a stray shopping cart in their lot.
Anyways, if you were denied restitution, you'd have to establish that a bailment was created and the damage occured due to lack of proper care. If you could prove the store was negligent in its parking lot operation you can also collect. With or without a notice.
